College Avenue, PO Box 709 Stanton, KY 40380-0709 Dear Chief Judge, Sara Walter Combs, I appreciate the time and effort you have taken to reply to FATHERS concerns. You have been the only member of the appellate court to even bother to take time to reply to my letters. This is a very clear indication of the remaining appellate court judges lack of concern, and lack of action, regarding the crisis that is ripping our families apart, and emotionally scaring our children, sometimes for life. I listen to a person s words, and believe their actions. You have set yourself apart from the judicial apathy that has created this national disgrace in at least as much as you publicly recognize the problem. In response to the fifth paragraph of page two of your letter regarding the Court of Appeals responsibility and authority: FATHERS is fully aware of the final authority of the judges that preside over divorce and custody cases. Our deep concern, and frustration, is the extreme differences in the various judges interpretation of the law. We have judges that are ruling 180 degrees differently on the same issues. For example: Chris Durbin was told by the McCracken County Family Court Judge that his child support would not be lowered if he changed careers and took a teaching job that he is seeking. He was told it would be considered voluntary unemployment . Glen Willett s ex was ordered to pay him $10/mo./child on his six children. $60 a month on six children, and she doesn t even do that. Glen s Marshal County judge just brushed it off. Most fathers would have gone to jail that day under a different judge! Some judges make excuses for marijuana use around children, Glen Willet s judge is one of these. His ex is on court video stating she self medicates herself with pot. Glen s judge considered the drug use on an equal plain with alcohol use. Other judges will not tolerate any type of drug use with the chance of children being involved. McCracken County Family Court Judge Sanderson has awarded a promiscuous homosexual parent as primary custodian over the father, Randall Moore, who attends church regularly. Other judges rule in favor of standard Christian values, and abstinence from sex for teenagers. If it is not up to the appellate court to define the interpretation of the KRS that judges use for drug use, child support, morality, ethics, and the well being of our children, then whose responsibility is it? How can one judge rule on a morality issue in determining custody, and another ignore the same morality issue? We must use the same standard for all of the state. It is up to the Appellate Court to decide one way or the other. Morals can not be used as findings of fact in one case, and then ignored by another judge that does not want to dictate morality . As difficult as this issue is, there is no other authority but the Appellate Court to make these determinations of the interpretation of the KRS. I am enclosing a binder FATHERS passed out at the August 4th Fancy Farm Picnic for your review. Our web page also contains an archive section on the lower left side of the page. This will give you more insight as to FATHERS goals and workings. Many of these documents are in MS works format. If you have any difficulty in opening something of interest, please email: mikeeast@vci.net and I will send it over in rich text file. Once again, thank you for taking time to consider our views and your reply. You have set yourself apart from the judicial apathy that has created this mess. I look forward to the actions that will substantiate the concern you have expressed for our families and children. Sincerely, Mike East President, FATHERS 800-472-3741 1673 Hamburg Rd.
